If you took deference to other parameters (I guess other parameters like merge stuff and navigation cache could be of importance?), this sounds like a product error. But: never have seen something like this, on no portal version. Build up a fully new navigation for a test user, changing only necessary stuff like display name and sort priority, does sorting working well for you?
